I. General Terms and Conditions

§ 1 Basic Provisions

(1) The following terms and conditions apply to contracts concluded with us as the provider (Mirsad Sheremeti) via the website yourluxelle.com unless otherwise agreed. Any terms you may use that deviate from these are explicitly rejected unless otherwise agreed.

(2) A consumer within the meaning of the following provisions is any natural person who enters into a legal transaction for purposes predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who acts in exercise of their trade, business, or profession when concluding a legal transaction.

§ 2 Conclusion of the Contract

(1) The subject matter of the contract is the sale of goods.

(2) By placing the respective product on our website, we provide you with a binding offer to conclude a contract under the terms specified in the product description.

(3) The contract is concluded via the online shopping cart system as follows:
The goods intended for purchase are placed in the "shopping cart." You can access the "shopping cart" via the corresponding button in the navigation bar and make changes there at any time. After clicking the "Checkout" or "Proceed to Order" button (or similarly labeled), entering your personal details, and selecting the payment and shipping conditions, a final order overview will be displayed.

If you use an instant payment system (e.g., PayPal, Amazon Pay, Sofort, giropay), you will either be directed to the order overview page in our online shop or to the payment system provider's website. After completing the payment process, you will be redirected to our online shop, where the order details will again be displayed.

Before submitting the order, you can review, modify, or cancel the order via the "back" function of your internet browser.

By submitting the order via the designated button ("place order," "buy now," or similar), you make a legally binding declaration of acceptance of the offer, resulting in the conclusion of the contract.

(4) The handling of the order and transmission of all information necessary for the conclusion of the contract is partially automated via email. You must ensure that the email address you provide is correct and that receipt of emails is technically ensured and not blocked by SPAM filters.

§ 3 Special Agreements for Payment Methods

(1) Payment via Klarna
In cooperation with the payment service provider Klarna Bank AB (publ), the following payment options are offered:

  • Invoice ("Pay Later"): Specific terms can be found at Klarna's websites for Germany and Austria.

§ 4 Retention of Title

(1) You may only exercise a right of retention insofar as it concerns claims arising from the same contractual relationship.

(2) The goods remain our property until full payment of the purchase price.

§ 5 Warranty

(1) Statutory defect liability rights apply.

(2) As a consumer, you are requested to check the goods upon delivery for completeness, obvious defects, and transport damage and to notify us and the carrier of any complaints as soon as possible. Failure to do so does not affect your statutory warranty claims.

§ 6 Applicable Law

(1) German law applies. For consumers, this choice of law applies only to the extent that it does not deprive you of protection provided by mandatory legal provisions of the country of your habitual residence.

(2) The provisions of the UN Sales Convention explicitly do not apply.
