Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity.)

Instructions on Withdrawal

Right of Withdrawal
You have the right to withdraw from this contract within one month without providing any reason.
The withdrawal period is one month from the day:

  • on which you or a third party designated by you, who is not the carrier, have or has taken possession of the goods, provided you have ordered one or more goods as part of a single order and these goods are delivered in a single shipment;

  • on which you or a third party designated by you, who is not the carrier, have or has taken possession of the last goods, provided you have ordered multiple goods as part of a single order and these goods are delivered separately;

  • on which you or a third party designated by you, who is not the carrier, have or has taken possession of the last partial shipment or the last item, provided you have ordered goods that are delivered in multiple partial shipments or pieces.

To exercise your right of withdrawal, you must inform us (Mirsad Sheremeti, Burgstraße 36, 72213 Altensteig, Phone: +49 1520 9739493, Email: yoursupport@myluxelle.com) by means of a clear declaration (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the communication regarding your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (except for additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 30 days from the day on which we received the notice of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used in the original transaction unless expressly agreed otherwise with you; in no case will you be charged fees for this repayment.

We may refuse repayment until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us without undue delay and in any case no later than 30 days from the day you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the period of 30 days has expired.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this diminished value results from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts:

  • for the delivery of goods that are not prefabricated and for the production of which an individual choice or decision by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer;
  • for the delivery of goods that can spoil quickly or whose expiration date would soon be exceeded;
  • for the delivery of alcoholic beverages, the price of which was agreed upon at the time of the contract and which can be delivered no earlier than 30 days after the conclusion of the contract and whose current value depends on market fluctuations over which the entrepreneur has no influence;
  • for the delivery of newspapers, magazines, or periodicals, except for subscription contracts.

The right of withdrawal expires prematurely for contracts:

  • for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery;
  • for the delivery of goods that, after delivery, are inseparably mixed with other goods due to their nature;
  • for the delivery of audio or video recordings or computer software in a sealed package if the seal was removed after delivery.

General Notes

  1. Please avoid damaging or contaminating the goods. If possible, return the goods in their original packaging with all accessories and all packaging components. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against transport damage.
  2. Please do not return the goods freight collect.
  3. Please note that the above points 1-2 are not prerequisites for the effective exercise of the right of withdrawal.
